Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of joinashworthpartners.com (the “Site”), operated by Ashworth Real Estate Partners LLC (“AREP,” “we,” “us,” or “our”), a Minnesota licensed-for-referral-only (LFRO) real estate brokerage. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The service

The Site provides general information about AREP’s referral-only brokerage program and lets you request information or submit a membership application. The Site and its content are informational only. Submitting a form is not a contract, an offer, or a guarantee of acceptance, income, or any particular outcome, and it does not create a brokerage or agency relationship. Membership and referral arrangements are governed by the separate agreements you enter into with AREP. This program is Minnesota-focused and intended for eligible Minnesota real estate licensees.

Acceptable use

When using the Site, you agree that you will not:

  • Submit false, misleading, or another person’s information without authorization;
  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to the Site, its accounts, or its systems;
  • Interfere with or disrupt the Site, or submit spam, malware, or automated/bulk submissions; or
  • Scrape, copy, or reuse Site content except as expressly permitted.

SMS / text messaging terms

If you provide your mobile number and opt in, you consent to receive SMS text messages from AREP related to your interaction with us — primarily transactional messages such as one-time codes to verify a login or confirm an action you requested. Opt-in is initiated by you, and we do not send marketing or promotional texts. By opting in, you confirm you are the subscriber or authorized user of the number provided.

SMS terms

  • Message frequency varies. You will receive messages only in response to actions you take, such as login verification.
  • Message and data rates may apply.
  • Reply STOP to opt out, HELP for help. Reply STOP to any message to opt out, or HELP for assistance. Carriers are not liable for delayed or undelivered messages.
  • We do not share or sell your mobile phone number, SMS opt-in, or messaging consent information with third parties or affiliates for marketing or promotional purposes.

Intellectual property

The Site, including its text, design, logos, and brand marks, is owned by AREP or its licensors and is protected by applicable law. “Ashworth Real Estate Partners” and related marks may not be used without our prior written permission. REALTOR® and MLS are marks of their respective owners.

No professional advice; no guarantee

Information on the Site is general in nature and is not legal, tax, or financial advice, and is not a guarantee of income or a representation about your specific license or situation. Real estate licensing rules vary — do your own diligence and consult your own professionals before making any licensing or business decision.

Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, AREP and its owners, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability arising out of or related to the Site will not exceed one hundred U.S. dollars (US $100).

Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Minnesota will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective date” above, and your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
